The Karnataka High Court has allowed WP No. 19069/2025 filed by Jayant Jadhav and Mayor Mangesh Pawar, setting aside their disqualification as corporators of the Belagavi City Corporation. The order was passed on January 13, 2025.
The petitioners, represented by Advocate Shivaprasad Shantanagoudar, challenged the disqualification ordered under Section 26(1)(K) of the Karnataka Municipal Corporation Act, 1976, which had been upheld by the Principal Secretary, Department of Urban Development, Bengaluru, affirming an earlier decision of the Regional Commissioner, Belagavi Division. The State was represented by the Additional Advocate General, while the complainant was represented by Senior Counsel Anant Mandagi.

The disqualification arose from allegations that the petitioners misused their status as corporators to procure shops at Tinisu Katte, constructed by the PWD, through an auction. However, the High Court noted that the auction for allotment of the shops was conducted in 2020, whereas municipal elections were held in September 2021 and the petitioners took oath as corporators only in February 2023.
Holding that there was no question of misuse of office since the petitioners were not corporators at the time of the auction, the High Court ruled that the provisions of Section 26(1)(K) were not attracted. Consequently, the court quashed the disqualification orders, granting full relief to Jayant Jadhav and Mangesh Pawar.
